Terms of Service

Welcome to MVP+ (“we,” “us,” “our”). These Terms and Conditions (“Terms”) govern your use of the MVP+ website, membership program, giveaways, and related services (collectively, the “Platform”). By registering, subscribing, or using MVP+, you agree to these Terms. If you do not agree, please do not use the Platform.

1. Membership

1.1 Eligibility

  • You must be 18 years or older and a resident of South Africa to participate in MVP+ giveaways.
  • Only one membership or account per individual is allowed.
  • Employees, contractors, and immediate family members of MVP+ may not enter giveaways.

1.2 Membership Tiers

  • MVP+ may offer free and paid membership tiers (e.g., Bronze, Silver, Gold, Platinum).
  • Benefits may include partner discounts, entries into promotional giveaways, and access to exclusive perks.
  • MVP+ can change membership benefits, pricing, or structure with prior notice.

1.3 Cancellations & Renewals

  • Paid memberships renew automatically unless cancelled.
  • Members can cancel at any time through their account settings.

2. Giveaways

2.1 Entries

  • Paid members automatically get giveaway entries based on their membership tier.
  • An Alternate Method of Entry (AMOE) is always available for free. For example, non-members may submit one free entry by [describe method: e.g., completing an online form or mailing an entry to MVP+ offices].
  • Each person can submit one free entry per giveaway cycle.

2.2 Winner Selection

  • Winners are chosen randomly and notified by email, SMS, or phone.
  • If a winner cannot be reached within 7 days, MVP+ can select another winner.

2.3 Prizes

  • Prizes are not transferable, exchangeable, or redeemable for cash unless required by law.
  • If a prize becomes unavailable, MVP+ may substitute it with one of equal or greater value.
  • MVP+ is not responsible for delays, damages, or issues caused by third-party suppliers.

2.4 Social Media Disclaimer

MVP+ giveaways are not sponsored, endorsed, or administered by, or associated with, Facebook, Instagram, TikTok, or any other social platform.

3. Partner Offers

  • MVP+ works with partner businesses to provide discounts and exclusive deals.
  • MVP+ does not manufacture, supply, or guarantee partner products or services. All transactions are between the member and the partner.
  • MVP+ is not responsible for quality, delivery, warranties, or disputes related to partner offers.
  • Partner names, logos, and trademarks displayed on MVP+ remain the property of their respective owners and are used with permission.

4. Third-Party Links

  • The MVP+ Platform may have links to third-party websites, including partner sites. These are provided for convenience only.
  • MVP+ does not control and is not responsible for the content, accuracy, availability, or practices of third-party websites.
  • Clicking on third-party links is at your own risk, and members should review the terms and policies of those sites before engaging.
  • MVP+ is not liable for any loss, damage, or issues from using third-party websites.

5. Payments

  • Payments are processed securely through trusted third-party gateways (e.g., Paystack).
  • All prices are listed in South African Rand (ZAR).
  • No refunds are given once membership is activated, except as required by law.

6. User Responsibilities

  • You agree not to misuse MVP+ for fraudulent purposes, including creating multiple accounts or trying to manipulate giveaway entries.
  • You are responsible for keeping your login details secure.
  • MVP+ can suspend or end memberships that violate these Terms.

7. Limitation of Liability

  • MVP+ provides the Platform on an “as is” basis without warranties of any kind.
  • MVP+ is not liable for indirect, incidental, or consequential losses, including lost profits or business opportunities.
  • In all cases, MVP+’s liability is limited to the total membership fees paid by the member in the 6 months before the claim.

8. Force Majeure

MVP+ is not responsible for any delay or failure in performance due to events beyond our control, including but not limited to strikes, internet outages, natural disasters, or government restrictions.

9. Privacy

Your personal information is handled according to our Privacy Policy, which complies with the Protection of Personal Information Act (POPIA). Once you leave MVP+ and visit a partner’s website, their privacy practices apply.

10. Amendments

MVP+ may update these Terms at any time. Members will be notified of important changes by email or website notice. Continued use of the Platform after changes means you accept the updated Terms.

11. Governing Law & Disputes

These Terms follow South African law. Any disputes will first be resolved through mediation or arbitration, and if that fails, will be handled by South African courts.

All prize draws and giveaways conducted by MVP+ are regulated as promotional competitions under Section 54 of the Lotteries Act 57 of 1997.
