MVP+ Promotional Competition Compliance Checklist (Section 54, Lotteries Act 57 of 1997)

By using MVP+, you agree to the practices outlined in this Privacy Policy.

Nature of the Competition

  • All prize draws and giveaways offered by MVP+ are conducted strictly as promotional competitions within the meaning of Section 54 of the Lotteries Act.
  • Each competition is intended primarily to promote the sale and use of MVP+ membership services, partner discounts, and related offerings, and is not conducted substantially as consideration for entry.

Membership Fees & Value

  • Membership subscription fees (Bronze, Silver, Gold, Platinum) are payable for access to discounts, partner benefits, and services, which constitute independent value apart from any competition entry.
  • The subscription fee is not increased or structured in such a way as to serve mainly as consideration for the opportunity to participate in a competition.

Free Alternative Entry (AMOE)

  • MVP+ provides a free, no-purchase-necessary method of entry that carries the same odds of winning as any paid entry.
  • The free entry route is:

Clearly disclosed in all promotional materials.
Easily accessible, without requiring disproportionate effort or cost (e.g., online form, email, or postal entry).
No distinction is made between paid and free entries in terms of treatment or eligibility.

Transparency & Disclosure

All competitions will have published rules setting out:

The start and end dates of the competition.
The method of entry (both paid and free).
The prizes offered (with approximate retail value).
The method of selecting winners (random draw, audited process).
Any restrictions (e.g., minimum age, residency requirements).
Winners will be publicly announced (unless opted-out for privacy), and records will be retained for audit.

Fairness & Oversight

The competition will be conducted in a manner that is:
Fair, transparent, and auditable.
Subject to independent oversight, such as third-party auditing of the draw process.
MVP+ undertakes not to mislead participants regarding chances of winning, prize values, or conditions.

Ministerial & Board Compliance

MVP+ acknowledges the authority of the Minister and National Lotteries Commission (NLC) to:

MVP+ will not offer cash equivalents where prohibited.

Record-Keeping

  • MVP+ will maintain:

Full accounting records of all competitions (entries, draws, prize distribution).
Evidence of compliance with the free entry route, disclosure, and winner selection process.
Records will be kept for a minimum of five years and will be made available for inspection by the NLC.

Liability & Disclaimers

MVP+ accepts liability only for the delivery of advertised prizes.

MVP+ is not liable for:
